If a decision has been made, then listed below are the conditions and reasons attached with the decision of Fingal County Council. The category of decision made, determines what is displayed under the type column:

In some cases, a combination of conditions, reasons, directives and informatives are used with regard to split decisions i.e. grant permission and refuse permission.

|
The roof of the proposed house shall be finished in blue/ black slates and the external walls finished in a render finish coloured a uniform colour with natural stone details.
REASON: In the interest of visual amenity.

The following requirements of the Planning Authority in respect of drainage and water supply shall be complied with in the development.
Foul Sewer
(i) No foul drainage is to discharge into the surface water system under any circumstances.
(ii) The foul drainage must be in compliance with the ‘Regional Code of Practice for Drainage Works Version 6.0’ Fingal County Council April 2006.
Surface Water
(i) No surface water/ rainwater is to discharge into the foul sewer system under any circumstances.
(ii) Soakways must comply with BRE Digest 365 and be at least 5m from the proposed dwelling.
(iii) The surface water drainage must be in compliance with the ‘Regional Code of Practice for Drainage Works Version 6.0’ Fingal County Council April 2006.
(iv) In the interest of water conservation and prevention of water wastage, the applicant is to examine re-using surface water run-off on the site. Details are to be submitted for written approval prior to the commencement of construction.
Water Supply
(i) All water fittings and installations must incorporate best current practices in water conservation.
(ii) The water supply for the development must comply with ‘Guidelines for Drinking Water Supply’, Fingal County Council February 2009, Revision 1.
REASON: In order to comply with the Sanitary Services Acts 1878 – 1964.

| Condition
|
The following requirements of the Transportation Department shall be complied with in this development:
(i) The front boundary of the site shall be set back 4.0 metres from the centreline of the existing carriageway. The strip between the edge of the carriageway and the boundary shall be levelled and grassed to County Council Standards and made available to the County Council when required.
(ii) The site entrance gates shall be recessed a minimum of 6m from the edge of the road carriageway in order that vehicles can queue off-road should the gates be in a closed position. Entrance gates (if any) shall open inwards to the site. Entrance shall be located to allow for the wing-walls from the entrance to the front boundary wall to be splayed at 45º on both sides. Details to be agreed with the Transportation department prior to the commencement of development.
(iii) The entrance opening shall be a maximum of 4 metres wide between piers.
(iv) Parking for two cars shall be provided within the curtilage of the site.
(v) The vehicular entry-splay (i.e. the paved area lying between the edge of the road carriageway and the gates/ piers of the site entrance or, it no gate is provided, to a point 6m from the edge of road carriageway) shall be constructed in a bound road material or other suitable material to a detail approved by the Area Engineer, Transportation Department. All stormwater shall be disposed of to soakpits or natural watercourse within the site and shall not discharge onto the public road.
(vi) No development of any form including planting, fences or wing walls shall exceed a height of 0.9 metres within the area required to provide visibility from the site entrance point. The visibility requirements to be agreed with the Transportation Engineer, Transportation Department.
(vii) All underground or overhead services and poles shall be relocated, as may be necessary, to a suitable location adjacent to the new boundary at the developer’s expense.
(viii) All the above works shall be carried out at the developer’s expense according to the Specification and Conditions of Fingal County Council.
REASON: In the interest of traffic safety and of the proper planning and sustainable development of the area.

|
The development shall be carried out in its entirety in accordance with the plans, particulars and specifications lodged with the application and Additional Information received on 16th september 2009, save as may be required by the other conditions attached hereto.
REASON: To ensure that the development shall be in accordance with the permission, and that effective control be maintained.

|
That the use of the structure (when completed) as a dwelling shall be restricted to use by the applicant and/or members of the immediate family for a minimum period of 7 years from the date of occupancy by the Applicant. The Planning Authority will however consent to any sale of the property by a lending institution in exercise of its powers as mortgagee.
REASON: In the interest of the proper planning and development of the area, regard being had to the policies and objectives of the Development Plan in relation to rural development, including the Council’s Rural Housing Policy.

Prior to commencement of development, the lands shall be in the applicant’s registered ownership, and documentary evidence of same shall be submitted to the Planning Authority.
REASON: In the interest of the proper planning and development of the area, regard being had to the policies and objectives of the Development Plan in relation to rural development, including the Council’s Rural Housing policy.

| Condition
|
The developer shall pay the sum of €26,312 (updated at date of commencement of development, in accordance with changes in the Tender Price Index) to the planning authority as a contribution towards expenditure that was/or that is proposed to be incurred by the planning authority in respect of public infrastructure and facilities benefiting development in the area of the Authority, as provided for in the Contribution Scheme for Fingal County made by the council. The phasing of payments and the giving of security to ensure payment shall be agreed in writing with the planning authority prior to the commencement of development.
REASON: It is considered reasonable that the payment of a contribution be required in respect of the public infrastructure and facilities benefiting development in the area of the planning authority and that is provided, or that is intended will be provided, by or on behalf of the Local Authority.
NOTE:
The applicant is advised that the parent permission, F04A/1287, to which the proposed development directly relates, expires on 13th December 2009. The applicant is advised that in the instance of a grant of permission for the proposed development, that any such grant of permission will expire on the same date as the parent permission F04A/1287.
