GRANT PERMISSION

If a decision has been made, then listed below are the conditions and reasons attached with the decision of Fingal County Council. The category of decision made, determines what is displayed under the type column:
- Conditions are associated with grants
- Reasons are given for refusals
- Directives are items requested under Additional Information
- Informatives are items requested under clarification of Additional Information
- Notes are reasons for invalidating a planning application
In some cases, a combination of conditions, reasons, directives and informatives are used with regard to split decisions i.e. grant permission and refuse permission.

| Condition
|
The following requirements of the Transportation Department shall be complied with in full;
(a) The proposed footpath shall be min 1.8m in width and shall tie-in to the existing footpath to the east of the proposed entrance.
REASON: In the interest of the proper planning and sustainable development of the area.

|
That the water supply and drainage arrangements, including the disposal of surface water, shall be in accordance with the requirements of the County Council and in this regard the following requirements of the Water Services Department shall be complied with in full.
Foul Sewer
(a) No foul drainage shall discharge into the surface water system under any circumstances.
(b) The foul drainage shall be in compliance with the ‘Regional Code of Practice for Drainage Works Version 6.0’ FCC April 2006.
Surface Water
(a) No surface water / rainwater shall discharge into the foul sewer system under any circumstances.
(b) The surface water drainage system, including rainwater butts, permeable pavement and soakways shall be fully implemented as detailed within the particulars submitted as part of the planning application.
(c) The surface water drainage shall be in compliance with the ‘Regional Code of Practice for Drainage Works Version 6.0’ FCC April 2006.
Water Supply
(a) All water fittings and installations shall incorporate best current practices in water conservation.
(b) All houses and apartments shall have 24 hour storage and individual water services to each unit. Connection details shall be submitted to the Planning Authority for written approval prior to the commencement of the development.
(c) The water supply for the development shall comply with the ‘Guidelines for Drinking Water Supply’ FCC February 2009 Revision 1.
REASON: In the interest of public health and in order to comply with the Sanitary Services Acts 1878-1964.

|
Prior to commencement of development, the developer shall submit a full landscape plan with full works specification and bill of quantities for the written approval of the Planning Authority.
REASON: In the interest of the proper planning and sustainable development of the area.

|
The Developer shall implement all mitigation measures identified in the Habitats Directive – Appropriate Assessment prepared by C.E. Lawler Consultant Ecologist and all measures detailed in the Additional Information submission dated 5th December 2011, in order to ensure the protection of Natura 2000 sites in the vicinity.
REASON: In order to ensure a satisfactory standard of development and to ensure the protection of Natura 2000 sites.

A low stone wall to the roadside boundary shall be provided in conjunction with the proposed footpath. Full details including all finishes shall be agreed in writing with the Local Authority prior to the commencement of development on site.

This permission approves 2 dwellings.
REASON: In the interest of clarity.

|
That all bathroom / en-suite windows in addition to windows serving the landing areas shall be fitted and permanently maintained with obscure glass, use of film is not acceptable.
REASON: In the interests of residential amenity.

Prior to commencement of the development the developer shall submit for the written agreement of the Planning Authority full details of all external finishes proposed to be used.
REASON: In the interests of visual amenity.

|
That the two dwellings shall be used as single dwelling units apart from such use as maybe exempted development for the purposes of the Planning and Development Regulations.
REASON: To prevent unauthorized development.

|
The development shall be carried out in its entirety in accordance with the plans, particulars and specifications lodged with the application and Additional Information received on 5th December 2011, save as may be required by the other conditions attached hereto.
REASON: To ensure that the development shall be in accordance with the permission, and that effective control be maintained.

That all necessary measures be taken by the contractor to prevent the spillage or deposit of clay, rubble or other debris on adjoining roads during the course of the works.
REASON: To protect the amenities of the area.

That all public services to the proposed development, including electrical, telephone cables and associated equipment be located underground throughout the entire site.
REASON: In the interest of amenity.

That no dwelling shall be occupied until all services have been connected thereto and are operational.
REASON: In the interest of the proper planning and sustainable development of the area.

That an acceptable house numbering scheme be submitted to and approved by the Council in advance of commencement of any works on site or marketing.
REASON: In the interest of the proper planning and sustainable development of the area.

|
The developer shall pay the sum of € 57,700 updated at date of commencement of development, in accordance with changes in the Wholesale Price Index (Building and Construction Materials) to the planning authority as a contribution towards expenditure that was/or that is proposed to be incurred by the planning authority in respect of public infrastructure and facilities benefiting development in the area of the Authority, as provided for in the Contribution Scheme for Fingal County made by the council. The phasing of payments and the giving of security to ensure payment shall be agreed in writing with the planning authority prior to the commencement of development.
REASON: It is considered reasonable that the payment of a contribution be required in respect of the public infrastructure and facilities benefiting development in the area of the planning authority and that is provided, or that is intended will be provided, by or on behalf of the Local Authority.
NOTE:
The issue of encroachment or oversailing is a civil matter the applicant is advised that in the event of encroachment or oversailing of adjoining property, the consent of the adjoining property owner is required.
